Privacy Policy

Under the Data Protection Law NYFM and the mediators are Data Controllers. We receive contact details and limited information from or on behalf of a party who makes a referral by completing the referral form. The referral form is available at www.nyfm.co.uk. The purpose is to enable us to offer proposed parties to mediation a Mediation Information and Assessment Meeting (MIAM).

During the MIAM and during mediation sessions with the assigned Mediator you may provide additional personal data. The data is that which is necessary to enable mediation services to be provided. The data will be used to keep up to date any data recorded and for the provision of mediation services only. It will be protected, and we shall make sure that no unauthorised person has access to it. It will never be sold or traded. It will not be shared without express permission except: –

1. As required by the Legal Aid Agency (LAA) if one or more of the parties qualifies for free mediation.

2. For professional and quality assurance standards including complaints required by the Family Mediation Council. Professional quality assurance standards include disclosure on a confidential basis to a Professional Practice Consultant or supervisor. If all parties agree then others such as an interpreter may be invited to a mediation session. If so the other will be subject to this privacy policy.

3. With an appropriate safeguarding agency if the need to share arises because of a risk of harm to any party or child.

4. To comply with the overriding obligation in law or regulation to disclose information.

The data will be stored for at least 6 years after the mediation ends to comply with the professional standards we work to, insurers and LAA requirements.

You can ask for details of certain personal data that we hold about you and if inaccurate ask for it to be amended or for it to be transferred to another mediation service provider.
